A popular way by which foreign entities, including multinational corporations, bring their labor capital from overseas, is the L-1 Visa program. The L-1 program is designed to lure foreign companies to do business in the United States, without having to disrupt, what is arguably their most precious asset: human capital. This program achieves such a lofty goal, by permitting for the foreign entities to bring key employees from abroad to the U.S.A. . It does so through mechanisms --- contrary to public belief, not all L-1 Visas are the same. The two main types of the L-1 Visa are L-1A and L-1B. What is the difference between L-1A versus L-1B.? The difference boils down to this: L-1A Visa category is tailored more towards supervisory/executive type of employees. On the other hand, the L-1B Visa category is tailored towards employees with specialized and/or customized skill sets. Before an organization makes consideration to take the hold step of using the L-1 program. It would need to do a lot of soul search, in terms of both keeping the underlying employee/intra-company transferee where productivity would be optimized, as well as, do some reality check, with regards to convincing the relevant U S based tax authorities to approve such petition requests.
