What is zoning?

Generally, zoning refers to the process, by which local governments regulate private land use and development. Zoning laws tend to be made at the municipal government level, and they essentially govern how a certain real property can and cannot be used. The process of making and enforcing zoning laws, has often been compared to that of sausage making. Zoning laws tend to draw from engineering recommendations and made by local politicians, which may be influenced by lobbyists and the electorate, with the final product often altered at the last stages, in order to hopefully survive constitutional and other legal challenges. Zoning laws are constantly changing, in order to keep up with technological and population changes which alter the maximum efficiency of land’s usage. The problem is that usually lawmakers are at least one step behind the technological changes. This problem is further compounded, when taking into account that localities may be lacking the enforcement mechanisms to enforce this due to budgetary and or personal shortfalls.
