This legal guide article aims to educate the public somewhat with regards to the current landlord-tenant laws, with emphasis on residential type of premises.

The applicable laws, rules and regulations in this area are subject and undergoing through constant changes. Time will only tell, whether or not there is any permanency (lasting power) behind many of the Covid 19 related legal changes.  An added layer of complexity and confusion among the public may be largely due to the roll out of the statutory provisions of the pre-Covid 19 dated and somewhat recently passed legislation: HSTPA of 2019.

 

A legal gray area.

One of the biggest misconceptions about NYC housing court actions, is that its operations are essentially dead; that is NOT necessarily true, since as of the time of this writing, the Housing Courts across all 5 boroughs, have been allowing for virtual court conferences. Residential landlord-tenant cases may have been impacted more than commercial type of cases, in large part due to the Covid-19 Emergency Eviction and Foreclosure Prevention Act of 2020.
