Generally, title search refers to a public record examination regarding real estate ownership. Typically, a title search involves the retrieval of physical and/or digital documents. The way a title search would be conducted will hinge on 3 things: (1) The laws of the jurisdiction; (2) Local land recordation customs and practices, and; (3) The title search requestor’s reasons for asking for the title search be conducted. It is important to keep in mind, that even the most thorough title search investigation may not spot all the potential title defects caused by fraudulent, incomplete and/or inaccurate title recordings. A title search investigation is often one of the most crucial components in obtaining title insurance. Frequently, a lender will initiate a title search investigation early on in the mortgage financing approval process. A title search investigation, may often be conducted on the behalf of the property owner, who is suspecting his property to be part of the property fraud scheme and/or is planning to bring an action to quiet title.
